Determination With Respect to Countries Providing Sanctuary to 
Indicted War Criminals

    Pursuant to the authority vested in me by section 573(d) of the 
Foreign Operations, Export Financing, and Related Programs 
Appropriations Act, 1998 (Public Law 105-118), I hereby determine that 
Serbia and Montenegro and the Republika Srpska Entity of Bosnia and 
Herzegovina and failed to take necessary and significant steps to 
apprehend and transfer to the International Criminal Tribunal for the 
Former Yugoslavia (the ``Tribunal'') all persons who have been publicly 
indicted by the Tribunal.
    This determination shall be provided to the Congress and published 
in the Federal Register.
