DEPARTMENT OF ENERGY

Office of Arms Control and Nonproliferation Policy; Proposed
Subsequent Arrangement

AGENCY: Department of Energy.

ACTION: Subsequent arrangement.

-----------------------------------------------------------------------

SUMMARY: The Department is providing notice of a proposed ``subsequent
arrangement'' under the Agreement for Cooperation Between the
Government of the United States of America and the Government of Canada
Concerning the Civil Uses of Atomic Energy and the Agreement for
Cooperation Between the Government of the United States of America and
the Government of the Republic of Korea Concerning Civil Uses of Atomic

being issued under the authority of Section 131 of the Atomic Energy
Act of 1954, as amended (42 U.S.C. 2160).
The subsequent arrangement RTD/KO(CA)-8 concerns the retransfer of
one low enriched uranium fuel bundle (one type contains 36-Element,
another type contains 18-Element) consisting of 100,000 grams of
uranium, of which 19,750 grams of the isotope U-235 is enriched to less
than 20 percent, from Canada to Republic of Korea for use as additional
fueling for the HANARO research reactor. This material is U.S. origin
and thus requires U.S. approval for retransfer to a third country.
In accordance with Section 131 of the Atomic Energy Act of 1954, as
amended, we have determined that this subsequent arrangement will not
be inimical to the common defense and security.
This subsequent arrangement will take effect no sooner than fifteen
days after the date of publication of this notice.

    Dated: April 30, 1999.

    For the Department of Energy.
Edward T. Fei,
Deputy Director, International Policy and Analysis Division, Office of
Arms Control and Nonproliferation.
