Prevention of Significant Deterioration Delegation of Authority 
to Kern County Air Pollution Control District

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of delegation of authority.

SUMMARY: The Regional Administrator for EPA Region 9 has delegated full 
authority to the Kern County Air Pollution Control District (KCAPCD) to 
implement and enforce the federal Prevention of Significant 
Deterioration (PSD) program.

EFFECTIVE DATE: The effective date of the delegation is August 12, 
1999.

SUPPLEMENTARY INFORMATION: Pursuant to 40 CFR 52.21(u), ``delegation of 
authority,'' the EPA has delegated authority to KCAPCD to implement and 
enforce the prevention of significant deterioration of air quality 
(``PSD'') program. Sections 160-169 of the Clean Air Act, and 40 CFR 
52.21. Under the PSD program, major stationary sources of air 
pollutants must apply for and receive a permit prior to construction of 
new facilities or certain modifications to existing facilities. EPA has 
reviewed KCAPCD's request for delegation and determined that KCAPCD has 
the necessary authority and resources to implement and enforce the 
program. While KCAPCD has been delegated the authority to implement and 
enforce the PSD program, nothing in the delegation agreement shall 
prohibit EPA from enforcing the PSD provisions of the Clean Air Act, 
the PSD regulations, or the conditions of any PSD permit issued by 
KCAPCD.

    The PSD Delegation of Authority is reviewable under section 
307(b)(1) of the Clean Air Act only in the Ninth Circuit Court of
