ACTION:

Notice of request for public comment.

SUMMARY:

The Department of State is seeking Office of Management and Budget (OMB) approval for the information collection described below. In accordance with the Paperwork Reduction Act of 1995, we are requesting comments on this collection from all interested individuals and organizations. The purpose of this notice is to announce the Department's plan to seek OMB approval of this collection for an additional three-year period, and to initiate a 60-day period for public comment preceding submission of the collection to OMB.

The Department will accept comments from the public up to January 3, 2023.

Abstract of Proposed Collection

Under Section 101(a)(27)(A) of the Immigration and Nationality Act (INA), 8 U.S.C. 1101 and INA section 203(b)(4), noncitizens may be issued a special immigrant visa as a returning resident if they are an immigrant, previously lawfully admitted for permanent residence, who is returning from a temporary visit abroad for more than one year due to circumstances outside of his or her control. The DS-0117 is used to collect information necessary to determine a returning resident's eligibility.

Methodology

Individuals will submit the DS-117 electronically via email or print the ( printed page 66344) form and submit to a U.S. embassy or consulate abroad for review.
