SUMMARY:

In this document the Federal Communications Commission (Commission) requests comments on a proposal to amend the Table of FM Allotments, by deleting vacant Channel 288A at Selmer, Tennessee, because it does not comply with the minimum distance separation requirements of the Commission's rules. A staff engineering analysis determines that Channel 288A at Selmer, Tennessee is short-spaced to Station WVNA-FM by nine kilometers, and there are no alternate channels available to alleviate the existing spacing conflict that would comply with the Commission's spacing requirements. The proposed Selmer deletion is consistent with the Commission's policy that it will not retain a vacant FM channel that would not comply with the Commission's spacing requirements.

Provisions of the Regulatory Flexibility Act of l980 do not apply to this proceeding. This document does not contain proposed information collection requirements subject to the Paperwork Reduction Act of 1995, Public Law 104-13. In addition, therefore, it does not contain any proposed information collection burden “for small business concerns with fewer than 25 employees,” pursuant to the Small Business Paperwork Relief Act of 2002, Public Law 107-198, see44 U.S.C. 3506(c)(4).

The Providing Accountability Through Transparency Act requires each agency, in providing notice of a rulemaking, to post online a brief plain-language summary of the proposed rule. For the reasons discussed in the preamble, the Federal Communications Commission proposes to amend 47 CFR part 73 as follows:

PART 73—RADIO BROADCAST SERVICES
