The National Park Service is giving notice to the public that First Class Miners Inc. has filed a proposed plan to use personal vehicles on two roads within Joshua Tree National Park to reach mining claims located outside the park.

SUPPLEMENTARY INFORMATION:
As mandated by the Mining in the Parks Act of 1976 (54 U.S.C. 100731et seq.) and the National Park Service (NPS) Organic Act of 1916, and to implement the General Mining Law of 1872 in the National Park System, the NPS promulgated regulations at 36 CFR part 9 Subpart A in 1977. These regulations are applicable to all mineral operations in park units related to unpatented and patented mining claims. Under the regulations, an NPS-approved plan of operations is required for mining-related operations in parks, including access through parks. The plan of operations serves as the blueprint for the operation and explains how and when the proposed operation will occur.
First Class Miners Inc. (FCM) owns placer mining claims outside Joshua Tree National Park. FCM seeks access via existing unimproved dirt roads through the park to its claims. FCM has submitted a proposed plan of operations for this access in accordance with the regulations at 36 CFR part 9A.
Under 36 CFR 9.17(a), the NPS is required to publish a notice in the
Federal Register
advising the public of the availability of the proposed plan for public review. This notice is being published to comply with the 36 CFR 9.17(a) requirement.
