Notice of Lodging of Proposed Consent Decree Under CERCLA

On September 9, 2026, the Department of Justice lodged a proposed Consent Decree between the United States and Goldcorp USA, Inc., Goldcorp, Inc., Glamis Rand Mining Company, New Verde Mines, LLC, and Yellow Aster Mining and Milling Company (“Settling Defendants”) with the United States District Court for the Eastern District of California in a case entitled United States v. Goldcorp USA, Inc., et al., No. 1:26-cv-07260-JLT-HBK.

The proposed Consent Decree resolves claims for response costs under Section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended, (“CERCLA”), 42 U.S.C. 9607, against Settling Defendants for the recovery of response costs incurred by the United States in connection with releases or threatened releases of hazardous substances into the environment at or from the Site known as the Rand Historic Mining Complex, in Kern County and San Bernardino County, California (the “Site”).

Under the proposed Consent Decree, Defendants will pay $5 million in exchange for a covenant not to sue for the Site from the United States, among other terms.

The publication of this notice opens a period for public comment on the Consent Decree. Comments should be addressed to the Assistant Attorney General, Energy and Natural Resources Division, and should refer to United States v. Goldcorp USA, Inc., et al., No. 1:26-cv-07260-JLT-HBK, DJ. The Consent Decree provides a covenant not to sue under Section 7003 of the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. 6973. Under Section 7003(d) of RCRA, a commenter may request an opportunity for a public meeting in the affected area. Any comments submitted in writing or at a public meeting may be filed by the United States in whole or in part on the public court docket without notice to the commenter.
