SUPPLEMENTARY INFORMATION:
I. Statutory and Regulatory Background
The Secretary of the United States Department of Housing and Urban Development (“Secretary”) administers the National Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. 5401et seq.) (the Act). Under this authority, the Secretary administers the Manufactured Home Construction and Safety Standards (24 CFR part 3280) and the Manufactured Home Procedural and Enforcement Regulations (24 CFR part 3282), as well as the Manufactured Home Installation Program that includes licensure of installers in HUD-Administered states (24 CFR part 3286). The Manufactured Home Procedural and Enforcement Regulations prescribe procedures for the enforcement of the Secretary's administration of these standards. Under 24 CFR 3286.209(b), the Secretary may suspend or revoke an installation license for, among other things, failing to comply with the requirements of 24 CFR parts 3285 and 3286, failing to take appropriate actions upon a failed inspection, and engaging in poor workmanship as evidenced by installing one or more homes that fail to meet the requirements of 24 CFR 3286.107.
II. Informal Presentation of Views for Mr. Wiegand
Scott Wiegand is currently licensed to install manufactured homes in HUD-Administered states with installer's license #IL20160193. The Office of Manufactured Housing Programs received multiple consumer complaints regarding manufactured home installations performed by Mr. Wiegand. An investigation showed that at least eight manufactured homes installed in Mays Landing, New Jersey, by Mr. Wiegand failed to comply with the manufacturer's installation instructions and the Model Manufactured Home Installation Standards (24 CFR part 3285). Further, although given multiple opportunities to correct these failures, the installations remain deficient.
In accordance with 24 CFR 3286.209(b), on November 24, 2025, the Secretary notified Mr. Wiegand of the intent to revoke his installer's license. On December 1, 2025, Mr. Wiegand responded stating that he disagrees with this determination. HUD construes this letter as a request for a presentation of views because Mr. Wiegand submitted a statement and documentation with his original letter.
Upon consideration of the factors identified in 24 CFR 3282.152(c)(4), the Secretary has determined that the Informal Presentation of Views will be held in accordance with the provisions of 24 CFR 3282.152(f). The parties involved in this proceeding are Scott Wiegand and the Secretary.
