Notice of Lodging of Proposed Consent Decree Under the Clean Air Act

On September 21, 2026, the Department of Justice lodged a proposed Consent Decree with the United States District Court for the District of Puerto Rico in the lawsuit entitled United States v. Steri-Tech, Inc., Civil Action No. 3:25-cv-01319.

The United States filed this lawsuit under the Clean Air Act. The United States' Complaint seeks injunctive relief and civil penalties for violations of the regulations that govern emission of ethylene oxide from Defendant's sterilization facility in Salinas, Puerto Rico. The Consent Decree requires the defendant to perform injunctive relief (compliance with a 99.99% removal efficiency standard for ethylene oxide) and pay a $700,000 civil penalty.

The publication of this notice opens a period for public comment on the Consent Decree. Comments should be addressed to the Principal Deputy Assistant Attorney General, Energy and Natural Resources Division, and should refer to United States v. Steri-Tech, Inc., D.J. Ref.
