ACTION:

Direct final rule; correction and confirmation of effective date.

SUMMARY:

The U.S. Nuclear Regulatory Commission (NRC) is correcting a notice that was published in the Federal Register on August 11, 2026. The NRC published a direct final rule amending its regulations by streamlining procedural provisions related to information withholding and post-promulgation comment periods; aligning the NRC's regulations with Committee Management Secretariat Federal Advisory Committee Act standards; and updating national security eligibility criteria. The corrections on the companion proposed rule document are necessary to replace an incorrect citation and incorrect citation date. The NRC is also confirming the effective date of October 26, 2026, for this direct final rule.

SUPPLEMENTARY INFORMATION:

On August 11, 2026 (91 FR 51555), the NRC published in the Federal Register (FR) a direct final rule amending its regulations in parts 2, 7, and 10 of title 10 of the Code of Federal Regulations to streamline procedural provisions related to information withholding and post-promulgation comment periods; align the NRC's regulations with Committee Management Secretariat (CMS) Federal Advisory Committee Act (FACA) standards; and update national security eligibility criteria. In the direct final rule, the NRC stated that if no significant adverse comments were received, the direct final rule would become effective on October 26, 2026.

The NRC received and docketed 16 comment submissions on the companion proposed rule (91 FR 51600; August 11, 2026). Electronic copies of the comments can be obtained from the Federal Rulemaking website at www.regulations.gov under Docket ID NRC-2025-1139 and are also available in ADAMS under Accession No. ML26268A096.

The NRC evaluated the submissions against the criteria described in the direct final rule and determined that the comments were not significant and adverse or were outside the scope of the direct final rule. Therefore, this direct final rule will become effective as scheduled.

The NRC is also correcting the companion proposed rule associated with this direct final rule to correct a citation and citation date. In section IV, “Background,” of the companion proposed rule, the citation date of December 16, 2026, for the General Services Administration's final rule at 90 FR 58408, is incorrect. In addition, in section V, “Plain Writing,” of the companion proposed rule, the citation of 63 FR 31883 to the “Plain Language in Government Writing” document that was published on June 10, 1998, is incorrect.

Correction

In the Federal Register of August 11, 2026, in FR Doc. 2026-16373, on page 51601:

a. In the second column, in section IV, “Background,” correct the second sentence of the last full paragraph to read as follows:

“On December 16, 2025, GSA issued a final rule (90 FR 58408) modernizing FACA regulations by updating definitions, improving reporting requirements, and incorporating contemporary practices for advisory committee operations and technology.”; and

b. In the third column, in section V, “Plain Writing,” correct the second sentence to read as follows:

“The NRC has written this document to be consistent with the Plain Writing Act as well as the Presidential Memorandum, “Plain Language in Government Writing,” published June 10, 1998 (63 FR 31885).”
