ACTION:

Notice of proposed rulemaking (NPRM).

SUMMARY:

The FAA proposes to adopt a new airworthiness directive (AD) for certain Baykar Piaggio Aerospace S.p.A. (Piaggio) Model P-180 airplanes. This proposed AD was prompted by a report of corrosion and cracks found around the head of attaching fasteners on main wing lower skin external reinforcement doublers. This proposed AD would require repetitive high frequency eddy current (HFEC) inspections of the lower skin reinforcement and, depending on findings, corrective action. The FAA is proposing this AD to address the unsafe condition on these products.

Background

The European Union Aviation Safety Agency (EASA), which is the Technical Agent for the Member States of the European Union, has issued EASA AD 2024-0006, dated January 9, 2024 (EASA AD 2024-0006) (also referred to as the MCAI), to correct an unsafe condition on certain Piaggio Model P-180 airplanes. The MCAI states a report of an occurrence of corrosion and cracks ( printed page 65145) was found around the heads of attaching fasteners on main wing lower skin external reinforcement doublers during scheduled maintenance on a Piaggio Model P-180 airplane. This condition, if not detected and corrected, could reduce the structural integrity of the main wing with consequent reduced control of the airplane. To address this unsafe condition, Piaggio issued material providing instructions for repetitive HFEC inspections of the affected parts and, depending on findings, accomplishment of corrective action.

You may examine the MCAI in the AD docket at regulations.gov under Docket No. FAA-2026-11809.

Material Incorporated by Reference Under 1 CFR Part 51

The FAA reviewed Piaggio Aerospace Service Bulletin 80-0494 Rev. 1, dated November 30, 2023. This material specifies procedures for repetitive HFEC inspections on the main wing lower skin external reinforcement doublers, and corrective actions for the parts with evidence of corrosion and cracks. Corrective actions include, depending on inspection findings, repairing or contacting Piaggio to obtain an approved repair design approval sheet.

The FAA also reviewed Piaggio Aerospace Service Bulletin 80-0482 Rev. 13, dated January 27, 2026. This material specifies weight and balance updates and identifies updates to the effectivity of manufacturer's serial numbers affected by the weight and balance updates.

The FAA also reviewed Subject 51-10-40, Allowable Damage, Piaggio Aerospace Structural Repair Manual, Report No. 180-MAN-0250-1106, Issue D0, dated November 2, 2021. This material specifies identifying what is considered allowable minor damage (not critical to affect flight safety or performance) to primary and secondary structures that may be corrected by a simple procedure.

This material is reasonably available because the interested parties have access to it through their normal course of business or by the means identified in the ADDRESSES section.

FAA's Determination

These products have been approved by the civil aviation authority of another country and are approved for operation in the United States. Pursuant to the FAA's bilateral agreement with this State of Design Authority, that authority has notified the FAA of the unsafe condition described in the MCAI and material referenced above. The FAA is issuing this NPRM after determining that the unsafe condition described previously is likely to exist or develop on other products of the same type design.

Proposed AD Requirements in This NPRM

This proposed AD would require accomplishing the actions specified in the material already described.

Costs of Compliance

The FAA estimates that this AD, if adopted as proposed, would affect 14 airplanes of U.S. registry.

The FAA estimates the following costs to comply with this proposed AD:

Estimated Costs

Action Labor cost Parts cost Cost per product Cost on U.S. operators
HFEC inspection 50 work-hours × $85 per hour = $4,250 (per inspection) $1,000 (per inspection) $5,250 (per inspection) $73,500 (per inspection).

On-Condition Costs

Action Labor cost Parts cost Cost per product
Corrosion removal (within the structural repair manual limits) 10 work-hours × $85 per hour = $850 (per repair) $1,000 (per repair) $1,850 (per repair).

The costs for any repair that would be required by the proposed AD (including repairs for corrosion found outside the limits of the structural repair manual) would vary from airplane to airplane. Therefore, the FAA has no way of determining the cost estimate for such repairs

Authority for This Rulemaking

Title 49 of the United States Code specifies the FAA's authority to issue rules on aviation safety. Subtitle I, section 106, describes the authority of the FAA Administrator. Subtitle VII: Aviation Programs, describes in more detail the scope of the Agency's authority.

The FAA is issuing this rulemaking under the authority described in Subtitle VII, Part A, Subpart III, Section 44701: General requirements. Under that section, Congress charges the FAA with promoting safe flight of civil aircraft in air commerce by prescribing regulations for practices, methods, and procedures the Administrator finds necessary for safety in air commerce. This regulation is within the scope of that authority because it addresses an unsafe condition that is likely to exist or develop on products identified in this rulemaking action.

Regulatory Findings

The FAA determined that this proposed AD would not have federalism implications under Executive Order 13132. This proposed AD would not have a substantial direct effect on the States, on the relationship between the national government and the States, or on the distribution of power and responsibilities among the various levels of government.

For the reasons discussed above, I certify this proposed regulation:

(1) Is not a “significant regulatory action” under Executive Order 12866,

(2) Would not affect intrastate aviation in Alaska, and

(3) Would not have a significant economic impact, positive or negative, on a substantial number of small entities under the criteria of the Regulatory Flexibility Act.
