SUMMARY:
On October 19, 2026, the U.S. Court of International Trade (CIT) issued its final judgment in
Galvasid S.A. De C.V.,
v.
United States,
Slip Op. 26-128, Consol. Court no. 25-00235, sustaining the U.S. Department of Commerce's (Commerce) first remand redetermination pertaining to the less-than-fair-value (LTFV) investigation of corrosion-resistant steel products (CORE) from Mexico covering the period of investigation July 1, 2023, through June 30, 2024. Commerce is notifying the public that the CIT's final judgment is not in harmony with Commerce's final determination in that investigation, and that Commerce is amending the final determination and the resulting AD order with respect to the dumping margin assigned to Galvasid S.A. De C.V. (Galvasid) and all other producers and/or exporters.

SUPPLEMENTARY INFORMATION:
Background
On August 29, 2025, Commerce published its
Final Determination
in the LTFV investigation of CORE from Mexico.[1]
After correcting ministerial errors contained in the
Final Determination,
on December 18, 2025, Commerce published the
Amended Final Determination and Order.[2]
Galvasid appealed Commerce's
Final Determination.
On July 24, 2026, the CIT remanded the
Final Determination,
directing Commerce to reconsider the dumping margin of Galvasid without applying facts otherwise available or an adverse inference predicated on Galvasid's failure to separately report freight or insurance revenue in the U.S. market.[3]
In its
Final Remand,
issued on September 22, 2026, Commerce reversed its finding of partial application of facts available, with an adverse inference, with respect to Galvasid's reporting of U.S. freight and insurance revenue, and revised the calculation of Galvasid's dumping margin by removing the adjustment to Galvasid's reported U.S. gross unit price, as well as the margin applied to all other companies.[4]
The CIT sustained Commerce's
Final Remand.[5]
Timken Notice
In its decision in
Timken,[6]
as clarified by
Diamond Sawblades,[7]
the U.S. Court of Appeals for the Federal Circuit held that, pursuant to section 516A(c) and (e) of the Tariff Act of 1930, as amended (the Act), Commerce must publish a notice of court decision that is not “in harmony” with a Commerce determination and must suspend liquidation of entries pending a “conclusive” court decision. The CIT's October 19, 2026, judgment constitutes a final decision of the CIT that is not in harmony with Commerce's
Final Determination.
Thus, this notice is published in fulfillment of the publication requirements of
Timken.
Amended Final Determination
Because there is now a final court judgment, Commerce is amending its
Final Determination
with respect to Galvasid and all-other producers/exporters as follows:
Exporter/producer
Weighted-
average
dumping
margin
(percent)
Galvasid S.A. De C.V
14.54
All Others

Amended Antidumping Duty Order
Pursuant to 735(c)(2) of the Act, Commerce shall “issue an antidumping duty order under section 736” of the Act when the final determination is affirmative. As a result of this amended final determination, Commerce is hereby amending the
Amended Final Determination and Order
to revise the weighted-average dumping margin assigned to Galvasid and all other producers and/or exporters of subject merchandise, as noted above.
Cash Deposit Requirements
Commerce will issue revised cash deposit instructions to U.S. Customs and Border Protection.
