SUPPLEMENTARY INFORMATION:
I. Discussion
On October 20, 2026, Last Energy filed the first part of a two-part phased construction permit application for a utilization facility with the NRC, pursuant to Section 103 of the Atomic Energy Act of 1954, as amended, and
( printed page 69896)
part 50 of title 10 of the
Code of Federal Regulations
(10 CFR), “Domestic Licensing of Production and Utilization Facilities.” Part One of the application includes a LWA request submitted pursuant to 10 CFR 50.10(d), “Request for limited work authorization.” Last Energy submitted part one of its application as part of a phased application approach for a construction permit for a utilization facility, as described in 10 CFR 2.101(a)(9) and 10 CFR 2.600(d).
Last Energy's LWA application requests NRC approval to conduct certain early construction activities for its PWR-20 nuclear reactor at a site in Caldwell County, Texas. The requested LWA activities would include installation of permanent elements of the foundation supporting the reactor vessel, including subsurface preparation, grout backfill, installation of a steel liner, and driving of steel H-piles. The application also includes certain general and administrative information such as financial qualifications submitted pursuant to 10 CFR 50.33, a preliminary safety analysis report submitted pursuant to 10 CFR 50.34(a) for the portions of the facility within the scope of the LWA, an environmental report submitted in accordance with 10 CFR 51.49(b) and (f), and a site redress plan.
II. Further Information
If the NRC staff finds the LWA request acceptable for docketing, the staff will begin a detailed technical review. Subsequent
Federal Register
notices will address the acceptability of the tendered application for docketing and opportunities for participation of the public during the course of the staff's review.
