Summary

The Bureau of Land Management, proposes to withdraw approximately 2,244 acres of public land to protect resources in the Beaverhead River area acquired by the United States with Land and Water Conservation Fund and North American Wetlands Conservation Act funding. This notice segregates the land described below upon acquisition by the United States for up to 2 years from location and entry under the general land laws, including the mining laws, subject to valid existing rights.

Supplementary Information

On October 5, 1999, a petition was approved allowing the Bureau of Land Management to file an application to withdraw the following described land from settlement, sale, location and entry under the general land laws, including location and entry under the mining laws, but not from leasing under the mineral leasing laws.

Tract 1--

Principal Meridian, Montana

T. 8 S., R. 10 W., Sec. 35, lots 3 and 4, and NW\1/4\SE\1/4\. T. 9 S., R. 10 W., Sec. 1, lots 6 to 22, inclusive; Sec. 2, lots 1 to 4, inclusive, S\1/2\N\1/2\, and S\1/2\; Sec. 11, lot 1 and N\1/2\, Excepting Therefrom that tract of land described in Deed dated June 22, 1946, recorded in Book 110 of Deeds, Page 263, records of Beaverhead County, Montana; Sec. 12, NW\1/4\NE\1/4\, S\1/2\NE\1/4\, NW\1/4\, E\1/2\SW\1/4\, NW\1/4\SW\1/4\, and SE\1/4\. Sec. 13, N\1/2\NE\1/4\ and NE\1/4\NW\1/4\, Excepting Therefrom, Certificate of Survey 889, all those portions conveyed to the State of Montana for State Highway purposes, those portions conveyed for railroad purposes, and those portions taken by the Declaration of Taking dated September 13, 1960.

Tract 2--

Certificate of Survey 889 which is a parcel of land located in the NW\1/4\ of sec. 11, Sec. 2, and lots 9 and 10 of sec. 1, T. 9 S., R. 10 W., PMM.

The above described land contains approximately 2,244.00 acres in Beaverhead County.

Notice is hereby given that an opportunity for a public meeting is afforded in connection with the proposed withdrawal. All interested persons who desire a public meeting for the purpose of being heard on the proposed withdrawal must submit a written request to the Montana State Director within 90 days from the date of publication of this notice. Upon determination by the authorized officer that a public meeting will be held, a notice of the time and place will be published in the Federal Register at least 30 days before the scheduled date of the meeting. The application will be processed in accordance with the regulations set forth in 43 CFR 2300. For a period of 2 years from the date of publication of this notice in the Federal Register, the lands will be segregated as specified above, subject to valid existing rights, unless the proposal is denied or canceled or the withdrawal is finalized prior to the end of the segregation. Further, the segregation does not preclude the issuance of land use permits, rights-of-way, or other authorizations that are needed to accommodate valid existing rights and previously authorized actions. All previously authorized activities and permitted uses of the segregated lands may be continued in accordance with the terms of the authorization.
