SUPPLEMENTARY INFORMATION: This ICR seeks approval under the PRA for revisions to the Claim Adjudication Process for Alleged Presence of Pneumoconiosis information collection. Regulations 20 CFR 718, subpart B establishes the relevant medical evidence development criteria regarding coal miners who apply for Black Lung Benefits Act (30 U.S.C. 901 et seq.) payments. The Division of Coal Mine Workers' Compensation is required to schedule a series of four diagnostic tests to help establish eligibility for black lung benefits. Each diagnostic test has its own form setting forth the medical results: Roentgenographic Interpretation (Form CM-933), Roentgenographic Quality Rereading (Form CM-933b), Medical History and Examination for Coal Mine Workers' Pneumoconiosis (Form CM-988), Report of Arterial Blood Gas Study (CM- 1159), and Report of Ventilatory Study (Form CM-2907). In addition, regulations 20 CFR 718.102 sets forth standards for accompanying chest radiographs (x-rays). This information collection has been classified as a revision, because the OWCP has made several clarifications to the data collection Federal Mine Safety and Health Act section 508 authorizes this information collection. See 30 U.S.C. 957. This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information, and the public is generally not required to respond to an information collection, unless it is approved by the OMB under the PRA and displays a currently valid OMB Control Number. In addition, notwithstanding any other provisions of law, no person shall generally be subject to penalty for failing to comply with a collection of information that does not display a valid Control Number. See 5 CFR 1320.5(a) and 1320.6. The DOL obtains OMB approval for this information collection under Control Number 1240-0023. The current approval is scheduled to expire on May 31, 2017; however, the DOL notes that existing information collection requirements submitted to the OMB receive a month-to-month extension while they undergo review. New requirements would only take effect upon OMB approval.
