OPM has examined this rule under Executive Orders 12866 and 13563. For the reasons discussed above, this rule is not a significant regulatory action under Executive Order 12866. This is not an E.O. 14192 regulatory action because this rule is not significant under E.O. 12866.

1. On page 49263, in § 351.901(c)(1), remove “The procedures in this part are” and add in its place “The procedures in this subpart are”.
2. On page 49264, in § 351.902:
a. In paragraph (b)(3), remove “an entity identified in § 351.901(c),” and add in its place “an entity identified in § 351.901(c)(3),”; and
b. In paragraph (c)(6), remove “filed by a party or party's representative and OPM” and add in its place “filed by a party, a party's representative, or OPM”.
3. On page 49265, in § 351.904(c), remove “OPM or the responsible agency may” and add in its place “OPM or the agency whose action is under appeal may”, and remove “an employee of the responsible agency or OPM” and add in its place “an employee of that agency or OPM”.
