Supplemental notice of proposed rulemaking (SNPRM).

SUMMARY:

This action supplements a notice of proposed rulemaking (NPRM) published by the FAA in the Federal Register on June 17, 2025, which proposed to establish Class E domestic en route airspace (Class E6) within a designated landmass and within 12 miles from a designated shoreline associated with the state of Alaska to facilitate the vectoring of instrument flight rules (IFR) aircraft on direct routes where the current en route structure is insufficient or improper within the proposed airspace areas. As revised in this SNPRM, the FAA now proposes to establish five discrete areas of Class E domestic en route airspace over the state. Due to redundancy, the NPRM also proposed to remove two Class E6 airspace areas and modify 101 Class E airspace areas extending upward from at least 700 feet or more above the surface of the earth (Class E5) to remove any portion extending upward from 1,200 feet above the surface. This SNPRM continues to propose these actions, but also now proposes to remove two Class E airspace areas extending upward from 1,200 feet above the surface, revoke a duplicate Class E5 airspace legal description, and redefine airspace areas from a “Point of Origin” instead of using their respective airport reference points. Finally, both the NPRM and this SNPRM propose administrative amendments to the legal descriptions of 101 Class E5 airspace areas that would correct or update nomenclature as needed. This action would support IFR operations while enhancing the safety and management of aircraft operations within the National Airspace System (NAS).

Authority for This Rulemaking

The FAA's authority to issue rules regarding aviation safety is found in Title 49 of the United States Code. Subtitle I, Section 106 describes the authority of the FAA Administrator. Subtitle VII, Aviation Programs, describes in more detail the scope of the agency's authority. This rulemaking is promulgated under the authority described in Subtitle VII, Part A, Subpart I, Section 40103. Under that section, the FAA is charged with prescribing regulations to assign the use of the airspace necessary to ensure the safety of aircraft and the efficient use of airspace. This regulation is within the scope of that authority as it would establish, modify, and revoke Class E airspace to support IFR operations in the state of Alaska.

Incorporation by Reference

Class E5 and E6 airspace areas are published in paragraphs 6005 and 6006, respectively, of FAA Order JO 7400.11, Airspace Designations and Reporting Points, which is incorporated by reference in 14 CFR 71.1 on an annual basis. This document proposes to amend the current version of that order, FAA Order JO 7400.11M, dated July 30, 2026, and effective September 15, 2026. These updates would be published in the next update to FAA Order JO 7400.11. FAA Order JO 7400.11M, which lists Class A, B, C, D, and E airspace areas, air traffic service routes, and reporting points, is publicly available as listed in the ADDRESSES section of this document.

Background

A variety of Class E airspace areas exist over the state of Alaska today. Class E airspace overlies the entirety of the state (and within 12 miles from the shoreline) beginning at 14,500 feet mean sea level (MSL) (excluding the Alaska Peninsula west of longitude 160°00′00″ W, and the airspace below 1,500 feet above the surface of the earth when in mountainous terrain greater than 14,500 feet MSL. Additionally, 101 unique areas of Class E5 airspace with diameters as great as 150 miles, along with two Class E5 airspace areas extending upward from 1,200 feet above the surface, cover a majority of the state. Furthermore, the state has two Class E6 domestic enroute airspace areas adjacent to the U.S./Canadian border that also extend upward from 1,200 feet above the surface: one along the northeast boundary of the state and the other along the southeast boundary of the state. The combined 105 Class E airspace areas create confusion with overly complicated charting, congested airspace, and unnecessary redundancy within the NAS.

The FAA previously published an NPRM for Docket No. FAA-2024-2333 in the Federal Register (89 FR 88182; November 7, 2024), proposing to modify the Class E6 airspace in the state of Alaska. That proposal was withdrawn on November 18, 2024, to allow the FAA time to provide additional supporting information (89 FR 92871). Later, the FAA published another NPRM for Docket No. FAA-2024-2333 in the Federal Register (90 FR 25523; June 17, 2025), proposing to establish, modify, and revoke Class E airspace over the state of Alaska. Interested parties were invited to participate in this rulemaking effort by submitting written comments on the proposal to the FAA. Three comments were received.

One comment identified a typographical error that has been corrected in this SNPRM. The other two comments were sent by civilian aviation associations and expressed concerns such as a “detriment to safety” if Class G (uncontrolled) airspace were to be eliminated below 14,500 feet MSL due to a lack of defined mountainous and non-mountainous areas, higher minimum en route altitudes (MEA), inadequate communication and/or surveillance coverage, a lack of flexibility for general aviation, a higher probability of encountering inclement weather such as icing, and an increased chance of contact with the surface caused by additional cloud clearance requirements. Suggestions for proposal modifications included maintaining areas within the State of Alaska in which Class G airspace extends up to 14,499 feet MSL, issuing more waivers to required infrastructure to allow for reduced minimum en route altitudes (MEA), or improvements to infrastructure to address ( printed page 61168) communication and surveillance gaps that could result in lower, more widely used MEAs that would promote IFR operations in the aforementioned areas of concern.

The FAA acknowledges the concerns from the two pilot associations and has modified the proposed airspace action within this SNPRM in a way that would preserve Class G airspace below 4,000 feet above ground level (AGL) in four areas that currently contain Class G airspace extending to 14,499 feet MSL.

Additionally, after publication of the NPRM, the FAA discovered discrepancies between the geographic coordinates for airport reference points as legally defined within the most recent final rules designating the airspace and the coordinates reported by the National Airspace System Resource (NASR). To mitigate current and future discrepancies and permit seamless integration into aeronautical charting and the NAS, the proposal as revised in this SNPRM uses a “Point of Origin” and geographic coordinates matching the NASR in place of the airport name for all airports affected by this action. The proposal similarly substitutes a “Point in Space” for references such as navigational aids (NAVAID) using matching geographic coordinates, as further described within this SNPRM.

The goal of this SNPRM remains the same as previous proposals, which is to simplify and minimize the controlled airspace coverage over the state of Alaska by proposing to establish five Class E6 airspace areas providing the same containment as the 105 Class E5 airspace areas extending upward from 1,200 feet that they would replace.

The Proposal

The FAA is proposing an amendment to 14 CFR part 71 that would modify the Class E airspace over the state of Alaska by establishing five new Class E6 domestic en route airspace areas; revoking two Class E6 airspace areas, one Class E5 airspace area extending upward from 700 feet above the surface, and two Class E5 airspace areas extending upward from 1,200 feet above the surface; and modify 101 Class E5 airspace areas extending upward from 700 feet above the surface.

Class E6 airspace is intended for en route operations and Class E5 airspace is intended for aircraft transitioning to/from terminal or en route environments. The FAA intends to simplify the NAS by establishing a singular, statewide Class E6 airspace area over Alaska. A statewide Class E6 airspace area would better meet the needs of aviators and air traffic control by more appropriately containing aircraft operating on area navigation (RNAV) or direct routes while simultaneously increasing clearance-from-cloud requirements for aircraft operating under visual flight rules.

The establishment of a statewide Class E6 airspace area would create redundancy with existing Class E airspace areas over Alaska. To reduce redundancy, clutter, and confusion amongst the flying public, air traffic control, and aeronautical charting, the existing “Northeast Alaska” and “Southeast Alaska” Class E6 airspace areas would be removed. Furthermore, the Class E5 airspace areas extending upward from 1,200 feet above the surface at Umiat, AK, and Yukon-Kuskokwim Delta, AK, would no longer be needed and would be removed. Finally, the 101 existing Class E5 airspace areas would be modified to remove those portions extending upward from 1,200 feet above the surface that become redundant as a result of the new areas of Class E6 airspace proposed within this SNPRM.

To resolve concerns about preserving Class G airspace expressed in the comments by two civilian aviation groups, the FAA is revising the proposal from the NPRM. In this SNPRM, the FAA is now proposing to establish four Class E6 airspace areas that would extend upward from 4,000 feet above the surface (instead of the standard 1,200 feet) to preserve Class G airspace within certain areas that currently lack Class E airspace extending upward from 1,200 feet above the surface. The four areas of Class E6 airspace under this revised proposal would be referred to as the “Northeast High Class E6” airspace, the “Southeast High Class E6” airspace, the “South High Class E6” airspace, and the “Northwest High Class E6” airspace.

The landlocked “Northeast High Class E6” airspace would share a border with the 141° west longitude on the U.S./Canadian border in the northeast portion of the state and would be approximately 50x200 miles in size. The “Southeast High Class E6” would be positioned along the shoreline near the U.S./Canadian border in the southeast portion of the state and would be approximately 110x170 miles in size. The landlocked “South High Class E6” would be centrally located in the southern portion of the state and would be sized at approximately 70x200 miles. The landlocked “Northwest High Class E6” would surround the intersection of the T246, T252, and T277 routes in the northwest corner of the state and would be sized at approximately 125x160 miles.

In compliance with 14 CFR 71.71 and FAA Order JO 7400.2R, Sec. 18-2-1, all Class E6 areas proposed within this SNPRM exclude the following areas: (1) that airspace 14,500 feet or more MSL when less than 1,500 feet above the surface; (2) that airspace over the Alaskan Peninsula west of longitude 160°00′00″ W; (3) regulatory special use airspace (prohibited and/or restricted areas, when active); and any airspace beyond 12 miles from Alaska's shorelines.

Moreover, the FAA is proposing to update 101 Class E5 legal description text headers by substituting a “Point of Origin” to be used in place of the airport as the primary reference point for the legal descriptions within this SNPRM. The “Point of Origin” would use the geographic coordinates associated with the respective airport's most recent rulemaking action as published in the Federal Register , as they are the center points of existing airspace. Using a “Point of Origin” would preserve the current lateral boundaries of the Class E5 airspace areas within this SNPRM (excluding Aniak, AK, Koyuk, AK, Talkeetna, AK, and Valdez, AK), even if geographic coordinates for the airport are adjusted in the NASR over time. Any reference to NAVAIDs or other entities that create design constraints or are no longer needed due to irrelevance or decommissioning, would be removed and/or replaced with a “Point in Space” to contribute to preserving the lateral boundaries of the affected airspace.

The legal descriptions for all aforementioned 101 Class E5 airspace areas extending upwards from 700 feet above the surface would be modified to: (1) remove the portion of Class E5 airspace extending upward from 1,200 feet above the surface, and (2) substitute a “Point of Origin” for the airport reference point.

Other proposed modifications are as follows:

The following Class E5 airspace areas would be amended to remove references to NAVAIDs without substituting a “Point in Space”: Anchorage, AK, Ted Stevens Anchorage International Airport; Aniak, AK, Aniak Airport; Fort Yukon, AK, Fort Yukon Airport; Koyuk, AK, Koyuk Alfred Adams Airport; Nome, AK, Nome Airport; Valdez, AK, Valdez Pioneer Field; and Yakutat, AK, Yakutat Airport.

The lateral boundaries of the airspace at Aniak, AK, Aniak Airport, Koyuk, AK, Koyuk Alfred Adams Airport, Talkeetna, AK, Talkeetna Airport, and Valdez, AK, Valdez Pioneer Field, would be modified a negligible amount (no more than 700 feet on any side) to eliminate their legal descriptions' reliance on NAVAID(s) and conform to a more standardized and simplified configuration while maintaining procedure containment. The Class E5 airspace at Port Heiden, AK, Port Heiden Airport, and Unalakleet, AK, Unalakleet Airport, would be modified to add exclusionary language omitting any airspace beyond 12 nautical miles from the shoreline. Finally, the legal description for Manokotak/New Airport, Manokotak, AK, is a duplication of the airspace at Manokotak Airport, Manokotak, AK, and would be removed.

Regulatory Notices and Analyses

The FAA has determined that this proposed regulation only involves an established body of technical regulations for which frequent and routine amendments are necessary to keep them operationally current. It, therefore: (1) is not a “significant regulatory action” under Executive Order 12866; (2) is not a “significant rule” under DOT Order 2100.6B, “Rulemaking and Guidance Procedure” (March 10, 2025); and (3) is expected to result in, at most, de minimis costs from compliance with applicable operating requirements or minor flight rerouting for operators choosing to navigate around the controlled airspace. Since this is a routine matter that will only affect air traffic procedures and air navigation, the FAA certifies that this proposed rule, when promulgated, will not have a significant economic impact on a substantial number of small entities under the criteria of the Regulatory Flexibility Act.

Environmental Review

This proposal will be subject to an environmental analysis in accordance with FAA Order 1050.1G, FAA National Environmental Policy Act Implementing Procedures, prior to any FAA final regulatory action.
