SUPPLEMENTARY INFORMATION:
Background
On May 13, 2026, Commerce published the
Preliminary Results
of this administrative review and invited interested parties to comment.[1]
On August 18, 2026, Commerce extended the deadline to issue these final results by 53 days.[2]
Accordingly, the deadline for these final results is now November 2, 2026.
For the events subsequent to the
Preliminary Results, see
the Issues and Decision Memorandum.[3]
The Issues and Decision Memorandum is a public document and is on file electronically via Enforcement and Compliance's Antidumping and Countervailing Duty Centralized Electronic Service System (ACCESS). ACCESS is available to registered users at
access.trade.gov.
In addition, a complete version of the Issues and Decision Memorandum can be accessed directly at
access.trade.gov/frnotices.
Commerce conducted this administrative review in accordance with section 751 of the Tariff Act of 1930, as amended (the Act).
Scope of the Order
4
The merchandise subject to the
Order
is shrimp from Vietnam. For a full description of the scope of the
Order, see
the Issues and Decision Memorandum.[5]
Analysis of Comments Received
All issues raised by interested parties in the case and rebuttal briefs are addressed in the Issues and Decision Memorandum. A list of the issues addressed in the Issues and Decision Memorandum is provided in Appendix I to this notice.
Changes Since the Preliminary Results
Based on a review of the record and our analysis of comments received from interested parties, and for the reasons explained in the Issues and Decision Memorandum, we made certain changes to the weighted-average dumping margins applied to the two mandatory respondents, Sao Ta Foods Joint Stock Company/FIMEX VN/Sao Ta Seafood Factory/Khang An Foods Joint Stock Company (collectively, Fimex Group) [6]
and Soc Trang Seafood Joint Stock Company; STAPIMEX (STAPIMEX), and the weighted-average dumping margin applicable to the non-examined companies that are eligible for a separate rate.
Use of Adverse Facts Available
For these final results, we are relying on adverse facts available (AFA), pursuant to sections 776(a) and (b) of the Act, in part, to value certain of STAPIMEX's chemical factors of production (FOP).[7]
This is because STAPIMEX failed to cooperate by not acting to the best of its abilities to comply with our requests to provide descriptions of these chemical FOPs.[8]
As partial AFA, we used the highest reported chemical surrogate value on
( printed page 70049)
the record of this review as the surrogate value for the five chemical FOPs with inadequate descriptions.[9]
Separate Rates
Commerce received comments from the Fimex Group on Commerce's preliminary separate rate determinations.[10]
Commerce addressed these comments in the Issues and Decision Memorandum and continues to find that the 29 companies listed in Appendix II are eligible for a separate rate, including the two mandatory respondents (
i.e.,
the Fimex Group and STAPIMEX).
The Act and Commerce's regulations do not address the establishment of a separate rate to be applied to companies not selected for individual examination when Commerce limits its examination in an administrative review pursuant to section 777A(c)(2) of the Act. Generally, Commerce looks to section 735(c)(5) of the Act, which provides instructions for calculating the all-others rate in an investigation, for guidance when calculating the rate for separate-rate respondents which Commerce did not examine individually in an administrative review.
For the final results of this review, Commerce has determined the weighted-average dumping margin for the Fimex Group to be 10.71 percent, and for STAPIMEX to be 6.36 percent.[11]
For the reasons explained in the Issues and Decision Memorandum, we are assigning the weighted-average of the dumping margins calculated for the Fimex Group and STAPIMEX to the non-examined respondents which qualify for a separate rate in this review.[12]
Vietnam-Wide Entity
In our
Preliminary Results,
we found that 132 companies failed to establish their eligibility for a separate rate and are considered to be part of the Vietnam-wide entity.[13]
Commerce received comments from the Fimex Group on the list of companies that were preliminarily considered to be part of the Vietnam-wide entity.[14]
Commerce addressed these comments in the Issues and Decision Memorandum and continues to find that 131 companies listed in Appendix III, which includes all companies listed in the
Preliminary Results
except for Khang An Foods Joint Stock Company, to be part of the Vietnam-wide entity.[15]
Because no party requested a review of the Vietnam-wide entity, and Commerce no longer considers the Vietnam-wide entity as an exporter conditionally subject to administrative reviews,[16]
we did not conduct a review of the Vietnam-wide entity. Thus, the weighted-average dumping margin for the Vietnam-wide entity (
i.e.,
25.76 percent), is not subject to change as a result of this review.
Final Results of Administrative Review
Commerce determines that the following estimated weighted-average dumping margins exist for the period February 1, 2024, through January 31, 2025:
Exporter
Weighted-average
dumping margin
(percent)
Sao Ta Foods Joint Stock Company/FIMEX VN/Sao Ta Seafood Factory/Khang An Foods Joint Stock Company

Disclosure
Commerce intends to disclose its calculations and analysis performed to interested parties for these preliminary results within five days of any public announcement or, if there is no public announcement, within five days of the date of publication of this notice in accordance with 19 CFR 351.224(b).
Assessment Rates
Pursuant to section 751(a)(2)(C) of the Act and 19 CFR 351.212(b)(1), Commerce has determined, and U.S. Customs and Border Protection (CBP) shall assess, antidumping duties on all appropriate entries of subject merchandise in accordance with the final results of this review.
For the Fimex Group and STAPIMEX, because the weighted-average dumping margins are not zero or
de minimis
(
i.e.,
less than 0.50 percent) in these final results, Commerce calculated importer-specific assessment rates on the basis of the ratio of the total amount of dumping calculated for each importer's examined sales to the total entered value of those sales. Where we do not have entered values for all U.S. sales to a particular importer, we will calculate an importer-specific, per-unit assessment rate on the basis of the ratio of the total amount of dumping calculated for the importer's examined sales to the total quantity of those sales.[18]
To determine whether an importer-specific, per-unit assessment rate is
de minimis,
in accordance with 19 CFR 351.106(c)(2), we also will calculate an importer-specific
ad valorem
ratio based on estimated entered values.
For the 27 separate rate applicants that were not selected for individual examination in this administrative review but qualified for a separate rate, which have been assigned a weighted-average dumping margin that is not zero or
de minimis
(
i.e.,
less than 0.50 percent), Commerce will instruct, and CBP shall assess, antidumping duties on all appropriate entries of subject merchandise at the liquidation rates specified in the table above.
For sales that were not reported in the U.S. sales data submitted by the mandatory respondents, we will instruct CBP to liquidate entries associated with those sales at the rate for the Vietnam-wide entity (
i.e.,
25.76 percent). For entries of subject merchandise during the POR produced by the mandatory respondents for which they did not know their merchandise was destined for the United States, we intend to instruct CBP to liquidate such entries at
( printed page 70050)
the Vietnam-wide rate if there is no rate for the intermediate company or companies involved in the transaction.
With regard to the 131 companies identified in Appendix III to this notice as part of the Vietnam-wide entity, we will instruct CBP to apply an
ad valorem
assessment rate of 25.76 percent to all POR entries of subject merchandise which were exported by those companies.
Commerce intends to issue assessment instructions to CBP no earlier than 35 days after the date of publication of the final results of this review in the
Federal Register
. If a timely summons is filed at the U.S. Court of International Trade, the assessment instructions will direct CBP not to liquidate relevant entries until the time for parties to file a request for a statutory injunction has expired (
i.e.,
within 90 days of publication).
Cash Deposit Requirements
The following cash deposit requirements will be effective upon publication of the final results of this administrative review for all shipments of the subject merchandise entered, or withdrawn from warehouse, for consumption on or after the publication date, as provided by section 751(a)(2)(C) of the Act: (1) for the mandatory respondents listed above, which have a separate rate, the cash deposit rate will be equal to the weighted-average dumping margin established in the final results of this review and listed in the table above; (2) for previously-examined Vietnamese and non-Vietnamese exporters not listed in Appendix II that received a separate rate in a prior completed segment of this proceeding, the cash deposit rate will continue to be the existing exporter-specific cash deposit rate; (3) for all non-Vietnamese exporters of subject merchandise which have not received their own separate rate, the cash deposit rate will be the rate applicable to the Vietnamese exporter that supplied that non-Vietnamese exporter; and (4) for all Vietnamese exporters of subject merchandise that have not been found to be entitled to a separate rate, the cash deposit rate will be the rate for the Vietnam-wide entity, (
i.e.,
25.76 percent). These cash deposit requirements, when imposed, shall remain in effect until further notice.
Notification to Importers Regarding the Reimbursement of Duties
This notice also serves as a final reminder to importers of their responsibility under 19 CFR 351.402(f)(2) to file a certificate regarding the reimbursement of antidumping and/or countervailing duties prior to liquidation of the relevant entries during this POR. Failure to comply with this requirement could result in Commerce's presumption that reimbursement of antidumping and/or countervailing duties has occurred and the subsequent assessment of double antidumping duties, and/or an increase in the amount of antidumping duties by the amount of the countervailing duties.
Administrative Protective Order (APO)
This notice also serves as a reminder to parties subject to APO of their responsibility concerning the return or destruction of proprietary information disclosed under APO in accordance with 19 CFR 351.305(a)(3), which continues to govern business proprietary information in this segment of the proceeding. Timely written notification of the return or destruction of APO materials, or conversion to judicial protective order, is hereby requested. Failure to comply with the regulations and terms of an APO is a violation which is subject to sanction.
Notification to Interested Parties
We are issuing and publishing these final results of administrative review and notice in accordance with sections 751(a)(1) and 777(i) of the Act.
Dated: November 2, 2026.

Acting Deputy Assistant Secretary for Antidumping and Countervailing Duty Operations.
